1. Acceptance of Terms

By accessing or using TestivAI ("Service"), operated by TestivAI ("Company", "we", "us", or "our"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, you may not use the Service.

By creating an account, you represent that you are at least 18 years old and have the legal authority to enter into these Terms.

2. Description of Service

TestivAI provides automated visual regression testing tools, including but not limited to:

Visual comparison and analysis of web page screenshots
AI-assisted analysis of visual changes
Dashboard for reviewing test results
SDKs and integrations for test frameworks
API access for programmatic usage

3. Proprietary Rights & Intellectual Property

All aspects of the Service, including but not limited to the REVEAL Engine™ (Regression Vision Evidence & Analysis Layer), algorithms, AI models, software, source code, user interface designs, documentation, and trade secrets are the exclusive property of TestivAI and are protected by intellectual property laws.

3.1 Ownership

TestivAI retains all right, title, and interest in the Service and all related intellectual property. Nothing in these Terms grants you any ownership rights in the Service.

3.2 Restrictions

You agree not to:

Reverse engineer, decompile, disassemble, or attempt to discover the source code, algorithms, or underlying architecture of the Service
Copy, modify, create derivative works of, or distribute any part of the Service
Use the Service to build a competing product or service
Conduct competitive analysis, benchmarking for publication, or performance testing intended for external distribution without prior written consent
Scrape, crawl, or use automated means to extract data from the Service beyond normal API usage
Remove, alter, or obscure any proprietary notices or labels on the Service

3.3 Confidentiality

Any technical details, implementation specifics, performance characteristics, or other non-public information about the Service that you may learn through your use constitutes confidential information. You agree not to disclose such information to third parties.

4. User Accounts

You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must notify us immediately of any unauthorized use.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for fraudulent purposes.

5. Acceptable Use

You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not:

Use the Service to process or store illegal content
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the integrity or performance of the Service
Upload malicious code, viruses, or harmful content
Use the Service in any way that could damage, disable, or impair its functioning

6. Data Rights

6.1 Your Data

You retain ownership of all screenshots, test configurations, and other content you submit to the Service ("Your Data"). You grant TestivAI a limited license to process Your Data solely to provide the Service.

6.2 Aggregated Data

TestivAI may collect and use aggregated, anonymized data derived from your use of the Service for purposes including improving the Service, developing new features, and generating industry insights. Such data will not identify you or your organization.

7. Beta Program

During the beta period, the Service is provided free of charge. We may modify features or impose usage limits with at least 30 days' notice.

The Service during beta is provided "as is" without warranty of any kind. We do not guarantee availability, accuracy, or reliability during the beta period.

8. Service Modifications

We reserve the right to modify, suspend, or discontinue any part of the Service at any time with reasonable notice. We will make commercially reasonable efforts to notify you of material changes.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TESTIVAI SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR REVENUES, WHETHER INCURRED DIRECTLY OR INDIRECTLY, OR ANY LOSS OF DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES.

IN NO EVENT SHALL TESTIVAI'S AGGREGATE LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICE EXCEED THE GREATER OF (A) THE AMOUNT YOU PAID TO TESTIVAI IN THE 12 MONTHS PRECEDING THE CLAIM, OR (B) ONE HUNDRED DOLLARS ($100).

10. Indemnification

You agree to indemnify and hold harmless TestivAI and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising out of your use of the Service or violation of these Terms.

11. Termination

Either party may terminate these Terms at any time. We may immediately suspend or terminate your access if you violate these Terms. Upon termination, your right to use the Service ceases immediately.

You may export your data before termination. We will retain your data for 30 days after termination, after which it will be permanently deleted.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of the State of Delaware, United States, without regard to conflict of law principles.

13. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes via email or through the Service. Continued use of the Service after changes constitutes acceptance of the updated Terms.
